Ok so here goes I will try and make the long story short. I pulled my son out of Condor Elementary School and put him on home school torward the end of last year. I filed a homeschool affidavit with the state like I was suppose to and have a copy of it on file here at home. All was well then this year I decided to Put my son in k12 Charter public school and we love it all is well there but beginning of october I recieved a phone call from the attendance lady for the district saying that my son had fallen through the cracks and was not shown as attending school I:E truant.I explained I had an affidavit for homeschool she said there was no record of it, but that she would look into is and get back with me if she needed anything. I NEVER heard back from her. Around Jan 11th I recieved a citation from sherriff for truancy stated that the attendance lady had submitted to the board to have us cited for truancy and the board voted yes on her lack of information. I got online and simply requested the copy of the affidavit from the state with same info I gave the attendance lady and the next morning I had a copy of it I also have a letter from the charter school showing my son has been enrolled there all year. So because she doesnt know how to do her job or is simply lazy now I have to cancel a family trip and go to court in March. I emailed out elected superintendent and asked him to look into this false charge and recieved a mail back saying that another person was gonna look into it and contact me that was on the 12th and here we are the 31st and still nothing from him.This is WRONG they should not be able to charge people with out factual imformation. I then recieved a letter stating I had to pay BAIL omgsh no one was arrested we havent done anything wrong and we have somthing stating we have to pay over 400.00 on or before the court date. This is beyond wrong.I have every intention of getting an attorney if the district doesnt rectify this matter immediately. 

Screw that i would already get an attorney that is BS all the way. What a stupid lady!!! I would so sue their azz even though you probably wont get any money becuz CA is broke i would still sue!!! 

LOL I agree I would probably get an IOU lol but sueing them would get it through there heads that they have to do things right and not step on people especially people that vote to put the in those positions.

didnt think I had to she said if there was an issue she would call me back. and all this new stuff happened on the 11th and 12th and I had to leave for nothern ca as my grandfather is dieing I left on the 13th and returned last night this is the first chance I will have to go in in person. 

when u take a child out of school what exactly do u have to do?

Sometimes I think emailing is best that way everything that is said is in writing and documented. 

when you take a child from school you and you decide to homeschool you have to file a homeschool affidavit and with draw the child from the school. they homeschool affidavits are suppose to be done in October but if you take the child out mid year you can still do them. 

Documentation of your conversations is a better bet. You can't document a face to face conversation. Hold on to phone records and print out all emails from everyone involved. Definitely get an attorney 

Wait, what kind of home school? Was yours a private home school? Is the affidavit only if you withdrew during the school year

Sure you can. You take notes during and follow up with an email to the person confirming the conversation and what came out of it. Same way thing you can do with a phone call. 

Hmmmmm....When I dis-enrolled my daughter from TPHS I just filled out a form and then enrolled her in CAVA last year, then when I wanted her to go to Monument HS, I just filled out another form at the school office and they took care of dis-enrolling her from CAVA. IN California a student CANNOT be enrolled in two schools at the same time, so the dis-enrolling and re-inrolling has to take place. You need to go in and talk to the Attendance and Expulsion office and show them your paperwork and see what's missing, maybe it was something that should have been forwarded to her from Condor, or even from the Charter school. 

Ok that's what I was thinking, Mari, I did the same with my son just it was at the end of the year.

I just suggest seeing Mrs. Jensen regarding the matter. She's been in charge of that department for the past 12-13 years, so something is amiss. Someone (not sure which side), didn't follow through with something, and that needs to be cleared up. There are hundreds of Education Code sections that govern how a school district runs, so follow through with Mrs. Jensen tomorrow if need be. You say that you "pulled" your child from Condor, did you do dis-enrollment paperwork there, and when you enrolled the child in the charter school, did they have you fill out a form to make sure he/she were dis-enrolled from the parting district? I do agree, someone dropped the ball either with the paperwork, or with the follow through. Also, there is a board meeting tomorrow evening that you can have 3 minutes to speak at, so maybe you can get some answers there. 

ok sorry it took so long to update yesterday was very busy as you all can imagin, so I talked to MR David Price, and Mari, the first person that I spoke to when this all began was Mrs. Jensen shes the one that said he fell through the cracks and that she would contact me if there were any other issues questions or if she needed anything from me, ok so Mr Price stated he did an investigation and that I had said I was intending on putting my son back in CES, he also stated that my son technically missed 55days of school While I was enrolling him in Cava, That during the time my son was in CES he missed 24 days out of the year that were unexcused. so I would have to got to court I politely explained that while my son was being enrolled in CAVA he was covered under my homeschool affidavit that I infact still homeschooling him and that even if I wasnt per the dates he was being enrolled if he wasnt being schooled he would have only missed 20days and all I would have been at fault of is not refiling an affidavit for this school year, but that CAVA doesnt require a homeschool affidavit as the are a public school. I also explained that I never intended to put my son back in that school as the reason I took him out was they were jepordising his health (another long story lol) and that I had stated that I had said he would NEVER attend another school in this district again.Then I stated that yes he did miss 24 days of that school year as we went home to northern CA for 4days that turned into 2 weeks as I was ambulanced to hospital and had an emergancy surgery in which we were in contact with School EVERY day while we were there, we were 500 miles away how was I suppose to get him to school. The principle said that my son was unexcused as it was me in the hospital and not my son. I think thats crud.so 14days of those 24 are for that reason and the other 10 questioned days were when he contracted lice from some one at that school and it was a pain to get rid of the bugs and guess what the school said that they can only excuse like 5 days of lice killing so I would think the bugs were dead and they would find an egg and send him home. And heres is the kicker you WILL ALL LOVE he stated and I quote "you appeared before a SARB board in March and we voted to cite you" I happily replied I appeared before nothing was notified about nothing so you are telling me my paper work appeared and you voted with out hearing my side of situation. If we had been notified of this SARB we would have been there and we could have possible averted a citation but no they dont tell you. They just do it with out you defending yourself THIS is wrong.So I told him I will happily go to court and I will happily call every radio station news station and an attorney and after I go to court I will happily sue the district. At least then maybe they will start letting families attend these secret SARB meetings.aka(school attendance review board). oh and yes to the one who asked if we are military yes we are military.

I have a child in school and I think the district sucks....mostly b/c of the budget cuts.
