If a civilian has medicinal marijuana on them and they are with a military member, even with a prescription (which I know are a joke) would the military member get in trouble? I only ask because it came up in one of my Criminology class and I did not know.

possibly, you cant have it on any federal property (base and housing), and the members are held responsable for spouses and visitors. also if its in a vehicle its considered possesion...like if there is a 20 year old and a 21 year old in a car and they have booze the minor can get charged.

Yes, yes. I understand the law as far as the basics go. But what we discussed was if two people were in a vehicle together (one being a military member), they got pulled over and were asked if there were drugs in the car. The non military person states yes but it is medicinal. Would the military member get in trouble with their unit or would be excused because the other person had a prescription? I could not answer it and neither could anyone else.

This kinda happen to me 12 years ago. My ex wife started smoking weed when I was deployed. Long story short: Came home and I know there was drugs in my jeep during the time I was gone. Went to base police they told me that if anything found in vehicle on base it is Military members responsibility.
If you are pulled over out in town it is the responsibility of the person who claims its theirs. Now if no one claims it. Then some police will charge the person whom was sitting where the drugs were found.
In my case I took the carpets out of my jeep and had them cleaned. and scrubbed the inside of the jeep out as a precaution. Oh, and pulled about 20 lighters out from behind the dash. Finally, told security my story, as a courtesy they ran the dog through my jeep. It was clean.

Yes, but if the script is written by say the hospital on base. His command would have to be notified, of his wifes medical script. So if they were pulled over right after from getting the script filled. Yeah, his command would be notified, but I would assume that all charges would be dropped.

Now if you are just driving around and happen to have it on you and it was filled 4 days ago.. I would consider that as possesion, unless she has a Dr note stating they were traveling, and she wasnt allowed to drive, at all. JMO

I did not even know that military docs write scrips for medicinal marijuana!!! Look out hospitals, there will now be a flood of wives running for your doors with sudden pain all over their body. RME

I know there are major stipulations to getting this. Like Cancer treatment, they are not just going to hand it to you for a migraine..LOL! All other options have had to be tried or some be in their final stage of the disease.

California even has a online source where you can register if you are prescribe marijuana.

The Medical Marijuana Program (MMP) was established to provide a voluntary medical marijuana identification card issuance and registry program for qualified patients and their caregivers. The web-based registry system allows law enforcement and the public to verify the validity of qualified patient or caregiver's card as authorization to possess, grow, transport and/or use Medical Marijuana in California

Unfortunately, it is not that hard to get a MMJ card, although many people DO need them for medicinal purposes versus having one just to be "legal" and "legally" smoke weed.

If you are a card holder, and get pulled over(not on base) you are exempt from any repercussions(granted you are not under the influence).

The way these MMJ card holders get their medicine is through things called "shops" or "dispensaries". In order to enter/buy from these places, you HAVE to have a valid MMJ card AND present it to the people working there.

Don't know if it has been answered but if you do have your MMJ card, you are still not allowed to smoke on base, and if you have any pipes/bongs/blunts in your car, you will get in major trouble(even though you are allowed to have that stuff in your car BECAUSE you are a MMJ patient)?
